Except for contrary legal provisions, these general conditions apply to all the activities of the Gottes Chatterie. These General Conditions, as well as all special conditions of the Gotte cattery, are deemed to be accepted by its buyers and suppliers, even if they are in contradiction with their own general or specific conditions. All derogations from these conditions must be noted in writing and notified by a person authorized to engage the cattery of the Gottes

1. The pedigree

• It is issued by "the Belgian feline association" where it is the subject of an official request.
• If available it will be given to you with the kitten. Otherwise, you will be sent to you immediately upon its reception.
• The exact dress of the animal is not guaranteed, it is based on observation at 2 months and at this age of interpretation errors are possible and it can also evolve during growth
  

2. Price and delivery

• The sale price of the animal is always expressed all the taxes included.A minimum guarantee deposit of 30% of the sale price is requested to confirm the reservation
• If the buyer renounces the purchase after reserving the seller keeps the security deposit as compensation
• The payment of the deposit marks your agreement on all the conditions included in this document
• The balance is paid at least 15 days before the scheduled delivery date
• The delivery date is set by a mutual agreement, as recognized by the buyer.de l’animal est toujours exprimé toutes taxe comprise
• The delivery must take place within three weeks of the date of availability beyond, the daily accommodation costs will be recorded. These additional costs must also be paid on delivery, unless a special agreement is concluded.
• Shipping costs are never included in the sale price, except for a special agreement.
• We strongly recommend that you put your kitten in quarantine for at least 21 days before integrating it into your other animals

3. Legal obligations

• The animal is delivered in order with compulsory vaccinations and electronically identified. It is also sterilized at three months, unless the animal is intended for reproduction.
• The seller also provided with the animal:
  - The European passport of the animal
  - The guarantee certificate

4. Title retention clause

• The transfer of ownership only takes place after full payment.
• 15 days after a reminder letter remained ineffective, the buyer authorizes the seller to take over the animal.
• This recovery takes place without any legal formality, the seller reserving the right to sell the animal to another customer.
• All sums already paid remain acquired from the seller in compensation

5. Clause de Confidentialité

• The two parties accept in advance to settle any disputes in private .
• Any offense on this agreement will lead to a financial penalty of € 5,000.

6. Living conditions

• The buyer undertakes to comply with the animal well -being law.
• The animal should not be held permanently in a room of less than 10 m².
• The seller must be informed immediately in the event of serious illness or sudden death of the animal.
• The seller has the right to demand a pathological result to establish the possible responsibility of the buyer.
• It is forbidden to have the claws surgically removed
• The buyer engage to:
  - Provide a free and permanent access to its litter bin, food and water.
  - Provide regular and quality veterinary care.former à la loi sur le bien être animale.

Non-compliance with one of these clauses leads to the break of the contract

7. Special condition for pet

• Prohibition to resell the cat being the subject of this contract
• If the cat being the subject of this contract is given, you must communicate to us the identity and the complete contact details of the new owner

8. Special conditions for the breeder

   1. Territorial limit

The sale of reproductive kitten descending from our line is authorized worldwide, except :

• • For all our lines in Belgium.
  • For kittens of Lambokitty Lia, for 2 generations in Norway and Sweden.
  • For the kittens of Ermionida Oscar for all generations in Greece and Cyprus.

After sterilization, the sale is authorized in all countries

Non-compliance with one of these clauses leads to the termination of the contract

2.  Breeding conditions

• It is forbidden to put the animal in reproduction with an animal from outside of the cattery.

• It is forbidden to put the animal in reproduction with a partner without a pedigree proving his quality of Maine Coon.

• It is forbidden to put the animal in reproduction before the age of 12 months !!!

• The animal cannot be loaned or rented for breeding purposes to a third part

All offense is liable to a fine of € 1,800 / offense

c. Conditions of sale

• • Prohibition to resell the cat being the subject of this non -sterilized contract
  • If the cat being the subject of this contract is sold, you must communicate to us the identity and the complete contact details of the new owner.
  • Prohibition to sell the cat or its descendants in laboratory, pet stores or cattery with more than 10 breedersThe buyer undertakes to conclude a sales contract with its customers which regulates in the same terms the rights and obligations towards the animal as this sales contract, and to inform the seller within 7 days of the conclusion of the contract. He also undertakes to send him on request a copy of the contract mentioning the name and address of the buyer accompanied by a veterinary certificate mentioning the NO and the identification number of the kitten attesting to his reproductive capacity.

Non-compliance with one of these clauses leads to the termination of the contract

9. Penalty of termination of this contract

• The buyer is beholden to the seller of a penalty equal to purchasing prices.
• Not only can the buyer is beholden to the seller of the financial penalty, but the seller has the right to take back over the animal while retaining the product of the sale.

10. Dispute Resolving

All disputes will be of the exclusive jurisdiction of the courts of the Huy judicial district, even in the event of a call for warranty or the plurality of defendants. The "Chatterie des Gottes" reserves the right to quote before the siege judge of the defendant. No methods of payment or execution will provide novation or derogation from this express clause of exclusive allocation of competence. Only the Belgian law will be applicable.

By signing this document the buyer acknowledges having read these conditions and have accepted them.
